JOB TITLE

Legal Senior Counsel Labor & Employment

WHAT YOU WILL DO

Corporate Counsel who supports General Counsel in handling HMGMA legal matters with focus on labor, employment, benefits, immigration, and workplace safety laws.  Coordinates with other Legal & Compliance Team Members to accomplish departmental objectives.

•    Advise company on day-to-day employment law issues to ensure company complies with various labor, employment, benefits, immigration, and workplace safety laws (including NLRA, Title VII, Section 1981, FMLA, ADA, ADEA, ERISA, and OSHA). 
•    Advise company on medical leave issues and workers’ compensation matters.
•    Advise company on termination of employment matters, including advising company of legal risks.
•    Advise HR on handling unemployment compensation claims.
•    Assist the company with drafting various employment policies and procedures.
•    Handle investigations, audits, and training in the areas of labor, employment, benefits, immigration, and workplace safety laws.
•    Research legal issues relating to labor, employment, benefits, immigration, and workplace safety laws. 
•    Draft memoranda to General Counsel, executives, and Team Members on various legal topics.  
•    Track and report any developments in labor, employment, benefits, immigration, and workplace safety laws. 
•    Independently handle a variety of litigation, arbitration, and mediation matters for the company (with emphasis on employment litigation and workers’ compensation cases).
•    Oversee handling of garnishments, service of process, and subpoena responses.
•    Always display exemplary ethical behavior, including: (1) being free of undue influence and conflicts of interest; (2) strictly complying with HMGMA policies and procedures; (3) being honest, transparent, and accountable; (4) report all known illegal or unethical behavior; and (5) protecting confidential information.
•    Administer, coordinate, and comply with all Business Management System (BMS), Environmental Management System (EMS), and Safety Management System (SMS) requirements.
•    Perform all other duties as assigned by the General Counsel.

WHAT YOU WILL BRING TO THE ROLE

•    Juris Doctor Degree from an ABA-accredited Law School required.
•    Excellent academic credentials (Top 30% of law school class preferred)
•    10 – 15 years of job-related experience preferred
•    6 – 8 years’ experience with concentration in labor and employment law. Independently handles a variety of litigation, arbitration, and mediation matters for the company (with emphasis on employment litigation and workers’ compensation cases).
•    MS Word/MS Excel/MS PowerPoint
•    Georgia State Bar law license (recommended)
o    If not, Georgia State Bar law license must be obtained within six (6) months of the employment.
•    Domestic / International travel required.

Physical Demands
While in Office:
This position is primarily sedentary and requires working at a desk and computer for extended periods. Responsibilities may include:
•    Occasional lifting of office supplies (up to 15 pounds)
•    Frequent use of hands and fingers for typing and handling documents
•    Ability to sit, stand, and walk within the office environment as needed


When in Production Area (if applicable):
•    Standing, walking, bending, and reaching for extended durations
•    Repeated lifting, carrying, pushing, or pulling of materials and products (up to 25–30 pounds)
•    Manual dexterity for handling power tools, machinery, or production equipment
•    Working in environments that may be noisy, hot, or require the use of personal protective equipment (PPE)
•    Ability to climb ladders or stairs and operate equipment safely and effectively
•    Capability to learn and work on multiple production processes, as required
•    Adequate visual and auditory abilities to identify safety hazards and communicate clearly
•    Consistent and punctual attendance
•    Ability to collaborate and perform effectively in a team-oriented environment
